Who can apply for disability retirement?
A New York City employee who fits into one of the six tiers established by the Comptroller’s Office can apply for disability retirement. There are multiple applications a disabled employee may be entitled to, each with its own set of requirements. If you are permanently disabled as a result of your employment, you should contact an attorney at Rella & Associates to discuss which application you are eligible to file with the City.
What is the deadline?
There are strict deadlines that are enforced as to when you can file an application for disability retirement. You can file your application while still an employee of the City, OR within 3 months of your last day on payroll, OR within 12 months from the end of the payroll period for which you were entitled to regular pay, if you were on leave of absence for medical reasons, including Workers’ Compensation.
